IMPORTANT: BY ACCESSING OR USING SKILLNURSE, YOU AGREE TO BE BOUND BY THESE TERMS. THIS AGREEMENT CONTAINS CRITICAL PROVISIONS REGARDING PLATFORM LIABILITY AND MEDICAL NEGLIGENCE.
1. Platform Nature & Disclaimer
SkillNurse operates strictly as a Technology Aggregator and Intermediary under the Information Technology Act, 2000 (India). We bridge the gap between Healthcare Professionals and Hospitals. We expressly disclaim that:
- We are NOT an employer, staffing agency, or medical service provider.
- We do NOT verify the physical authenticity of medical degrees, nursing council licenses, or the clinical safety standards of hospitals. This is the sole and legal responsibility of the engaging Users.
2. Credentials & Zero Tolerance
- Accuracy: You declare under penalty of perjury that all information provided (Education, Nursing Council Registration, Experience) is 100% accurate.
- Fake Credentials: SkillNurse has zero tolerance for fake credentials. Any user found uploading falsified documents will be permanently banned, and data may be reported to the Indian Nursing Council or local Cyber Crime authorities.
3. Shift Conduct & No-Shows
- Hospital SOPs: When accepting a "Live Duty," you agree to adhere to the Hospital's Standard Operating Procedures (SOPs). You are solely responsible for your clinical actions and patient care.
- No-Shows: Accepting a shift and failing to report disrupts critical healthcare. Repeated "No-Shows" will lead to a permanent platform ban.
4. Verification Burden & Liability
- Mandatory Physical Check: SkillNurse provides candidate data on an "As-Is" digital basis. It is your mandatory legal duty to physically verify original documents, conduct background checks, and assess medical fitness before allowing candidates entry into sensitive wards (ICU, OT).
- No Platform Liability: SkillNurse is not liable for any medical negligence, theft, or misconduct committed by a candidate found through our Platform.
5. Financial Independence
- Direct Payments: The contract for any shift is strictly between the Hospital and the Nurse. SkillNurse is not a party to this contract.
- Payment Disputes: SkillNurse is not responsible for the non-payment or delayed payment of stipends by the hospital. Financial disputes must be resolved directly between the Facility and the Professional.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLNURSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Medical malpractice, patient injury, or death occurring at a participating Hospital.
- Loss of wages, profits, or data.
- Workplace harassment or disputes between users.
In no event shall our total liability exceed ₹1,000 INR.
7. Indemnification
You agree to defend, indemnify, and hold harmless SkillNurse from any claims, damages, losses, and legal fees arising out of your clinical actions, violation of medical laws, or violation of these Terms.
8. Governing Law & Contact
These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat.
